These Terms of Service (“Terms”) govern your access to and use of our website located at https://urbanriseapparel.shop/ (the “Site”), including all content, functionality, and services offered through the Site, as well as any purchase of products (T‑shirts, hoodies, and related accessories) from Urbanriseapparel.

By using the Site, placing an order, or clicking “I agree” where that option is presented, you accept and agree to be bound by these Terms, our Shipping Policy, and our Return & Refund Policy, all of which are incorporated herein by reference. Urbanriseapparel strives to display accurate product descriptions, colors, and sizing information for all T‑shirts and hoodies. However, we do not warrant that product descriptions, photographs, or other content on the Site are error‑free, complete, or current. If a product offered by Urbanriseapparel is not as described, your sole remedy is to return it in unused condition in accordance with our Return & Refund Policy.

Colors & Display:
The colors of garments as seen on your screen may vary depending on your monitor settings. Urbanriseapparel cannot guarantee that your screen’s display of any color will be accurate.

Availability:
All products are subject to availability. We reserve the right to discontinue any product at any time without notice. If an item becomes unavailable after you place an order, we will notify you via email and either issue a full refund or offer a comparable replacement.

Pricing:
All prices listed on the Site are in United States Dollars (USD) and exclude shipping charges, which are calculated at checkout ($6.99 flat rate for standard shipping). Prices are subject to change without prior notice. However, once you have placed an order, the price is locked in and will not be increased.

Typographical Errors:
In the event a product is listed at an incorrect price due to a typographical error, system error, or error from a supplier, Urbanriseapparel reserves the right to refuse or cancel any orders placed for that product at the incorrect price, even after an order confirmation has been sent. If your order is canceled, we will notify you and issue a full refund.

5. ORDERS, PAYMENT & CANCELLATION

Order Acceptance:
Your placement of an order constitutes an offer to purchase. Order confirmation emails are automated acknowledgments and do not constitute acceptance. Acceptance occurs when we ship the product(s) and send a shipping confirmation email. Urbanriseapparel reserves the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, suspected fraud, payment verification failure, or shipping address verification failure.

Payment Methods:
We accept the following payment methods: Visa, Mastercard, American Express, Discover, PayPal, Shop Pay, Apple Pay, Google Pay, and Urbanriseapparel gift cards. All payments are processed through secure, PCI‑compliant gateways. Urbanriseapparel does not store full credit card numbers.

Order Cancellation by Customer:
You may request cancellation of an order before it is shipped. To cancel, email support@urbanriseapparel.shop with “CANCEL ORDER – [Order Number]” in the subject line. If the order has not yet entered the handling phase (before 5:00 PM EST on the same business day), we will cancel it at no charge. If the order has already been processed or shipped, you must follow the standard return procedure (Return & Refund Policy, Section 3). Cancellation is not guaranteed after the 5:00 PM EST cut‑off.

Order Cancellation by Urbanriseapparel:
If we cancel an order for any reason (e.g., suspected fraud), we will notify you and issue a full refund to the original payment method within 3 business days.

6. SHIPPING & DELIVERY

All shipments from Urbanriseapparel are governed by our Shipping Policy, which you can review at https://urbanriseapparel.shop/shipping-delivery/. Key provisions include: Handling time of 1 business day, cut‑off time of 5:00 PM EST (Monday – Friday), a standard flat rate of $6.99 via USPS, UPS, or FedEx, and transit time of 2 – 4 business days after dispatch. By placing an order, you agree to the Shipping Policy in its entirety. Urbanriseapparel is not responsible for delays caused by carriers, weather, or events beyond our reasonable control.

7. RETURNS & REFUNDS

All returns, refunds, and exchanges are governed exclusively by our Return & Refund Policy, available at https://urbanriseapparel.shop/refund_returns/. In summary: return window of 30 calendar days from delivery, refund processing within 7 business days of receiving your return, and no restocking fees or return processing fees. By purchasing from Urbanriseapparel, you acknowledge and agree to the Return & Refund Policy. No other return or refund terms apply unless required by law.

8. INTELLECTUAL PROPERTY RIGHTS

Ownership:

Some states do not allow the exclusion of certain warranties, so the above limitations may not apply to you. In such states, our liability is limited to the maximum extent permitted by law.

11. LIMITATION OF LIABILITY

Some jurisdictions do not allow the limitation of liability, so the above may not apply to you.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Urbanriseapparel and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs (including reasonable attorneys’ fees) arising out of or relating to: your violation of these Terms, your use of the Site or any product, your violation of any third‑party rights, or any User Content you submit. Dispute Resolution – Mandatory Binding Arbitration:
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased from Urbanriseapparel shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Johnson County, Connecticut. Either party may bring a claim in small claims court in Johnson County, Connecticut, if the claim qualifies.

Class Action Waiver:
You and Urbanriseapparel agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class‑wide arbitration. By agreeing to binding arbitration, both parties waive the right to a trial by jury.

Opt‑Out:
If you do not wish to be bound by this arbitration provision, you may opt out by sending a written notice to support@urbanriseapparel.shop within 30 days of the date you first agree to these Terms. Any claim arising out of these Terms or your purchase must be filed within one (1) year after the claim arose, or it is permanently barred.

16. SEVERABILITY & WAIVER

18. FORCE MAJEURE
